1. About Mappetize

Mappetize is a platform that helps people discover local restaurant specials, happy hours, and events on a map, and helps restaurants and other food and drink establishments promote their offerings to nearby customers. Mappetize LLC is an Illinois limited liability company. You can reach us at [email protected].

2. Eligibility

You must be at least 13 years old to use Mappetize. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using Mappetize on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and the entity.

3. Accounts

You may create an account using Google Sign-In, email, or other authentication methods we make available. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent or abusive behavior, or remain inactive for an extended period, at our sole discretion.

4. Free Access for People

Discovering specials, browsing the map, and exploring restaurant listings is free. We do not charge people to use the core discovery features of Mappetize. A free account gives you access to features like saving favorites and receiving notifications (features may vary and are subject to availability). We reserve the right to introduce optional premium features or paid tiers for individuals in the future, but core discovery will remain free.

5. Restaurant Subscriptions and Payments

Restaurant owners and operators can claim their listing and manage their specials, analytics, and other business tools by subscribing to a paid plan. Current pricing is as follows:

• Founding Partner rate: $49 per month, locked for life for the first 20 qualifying restaurants. The rate stays in effect as long as your subscription stays active. A payment failure that is resolved within 14 days (e.g., an expired card updated after a Stripe retry) does not count as a lapse. If you cancel or your subscription lapses for more than 14 days, you re-subscribe at the standard rate.
• Standard rate: $99 per month

Subscriptions are billed monthly in US dollars and are subject to applicable taxes. We may adjust pricing from time to time with at least 30 days' advance notice to existing subscribers. We may also offer different plans, add-ons, or promotional pricing at our discretion.

Payment Processing

Payments are processed by Stripe, our third-party payment processor. We never receive or store your full credit card number. By subscribing, you authorize us to charge your payment method on a recurring monthly basis through Stripe. If a payment fails, we may notify you and suspend your subscription until payment is resolved. Stripe's terms and privacy policy govern the processing of your payment information.

Cancellation and Refunds

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period. No refunds or credits are issued for partial billing periods. After cancellation, your listing will revert to an unverified state and premium features will no longer be available.

Diner Data in the Owner Dashboard

Your Mappetize dashboard includes an activity feed of diner check-ins at your place. By default, each diner appears anonymously, labeled as a new, returning, or regular customer based on their check-in history at your place. A diner may choose to share their first name and profile photo with your dashboard by opting in. You agree to treat that information as follows:

• Do not attempt to identify anonymous diners through combinations of time, deal, or other signals in the feed.
• Do not retain, export, publish, or sell any activity-feed data off the Mappetize platform, including screenshots that include diner names or photos.
• Use diner information only to operate your restaurant and recognize your regulars. Do not use it for marketing, advertising, or direct outreach without the diner's separate, explicit consent obtained outside of Mappetize.

Violating these terms may result in immediate suspension or termination of your subscription without refund.

6. Content and Data Accuracy

Mappetize displays information about restaurants, specials, events, and promotions sourced in multiple ways:

• Automatically collected (unverified):Our systems periodically review publicly available restaurant websites and other public sources to collect information about specials and promotions using automated tools and AI. This information may be incomplete, out of date, or inaccurate. We label these as "Unverified."
• Verified by the restaurant:Information entered or confirmed directly by the restaurant owner or operator through their Mappetize dashboard. These are labeled "Verified."
• Third-party data: We use public data sources including the Google Places API for restaurant names, addresses, photos, and other listing details.

We do not guarantee that any information displayed on Mappetize, including specials, prices, hours, or promotions, is current, complete, or accurate. Specials and promotions change frequently. Always confirm details directly with the restaurant before visiting. Mappetize is not responsible for any loss, inconvenience, or disappointment resulting from reliance on information displayed on the Service.

7. Restaurant Listings

Restaurant listings on Mappetize are sourced from publicly available data, including Google Places and restaurant websites. If you are a restaurant owner or operator and wish to correct, update, or remove your listing, contact us at [email protected]. We will process reasonable requests in a timely manner.

By claiming a listing and submitting information to Mappetize, restaurant operators represent that the information is accurate and that they have the right to publish it. You are responsible for keeping your listing information current and for complying with all applicable laws, including alcohol and beverage laws when promoting happy hours or drink specials.

8. User Content

You may submit content to Mappetize, including but not limited to restaurant information, specials, photos, reviews, check-ins, and other materials ("User Content"). You retain ownership of your User Content, but by submitting it, you grant Mappetize a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, distribute, and create derivative works from your User Content in connection with operating and promoting the Service. This license continues even if you stop using the Service, to the extent your User Content has been shared with others or incorporated into the Service.

You represent that you own or have the necessary rights to submit your User Content and that it does not violate any third-party rights.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Submit false, misleading, or fraudulent information
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Access or collect data from the Service through automated means (scraping, bots, crawlers) without our prior written consent
• Interfere with or disrupt the Service, servers, or networks connected to the Service
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use the Service to send unsolicited communications, promotions, or spam
• Post or transmit content that is illegal, defamatory, harassing, threatening, obscene, or that infringes on third-party rights
• Circumvent any access controls, rate limits, or security measures

We may investigate and take action against violations of this section, including removal of content, suspension of accounts, and reporting to law enforcement.

10. Intellectual Property

The Mappetize name, logo, visual design, software, and all other proprietary content and materials are owned by Mappetize LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use our brand assets, trademarks, or proprietary materials without our prior written permission.

Restaurant names, logos, and related content submitted by restaurant operators remain the property of their respective owners. By submitting such content, you grant Mappetize the license described in Section 8.

11. Third-Party Services

Mappetize integrates with and relies on third-party services, including but not limited to Google Maps, Google Sign-In, Stripe, and Supabase. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party services, and your interactions with them are at your own risk.

The Service may contain links to third-party websites or resources. We provide these links for convenience only and do not endorse or assume responsibility for their content.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MAPPETIZE LLC AND ITS MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, AND LICENSORS (COLLECTIVELY, THE "MAPPETIZE PARTIES") SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF THE MAPPETIZE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE TOTAL AGGREGATE LIABILITY OF THE MAPPETIZE PARTIES FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO MAPPETIZE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

14. Indemnification

You agree to indemnify, defend, and hold harmless the Mappetize Parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

15. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.

You agree that any claim or cause of action arising out of or related to your use of the Service must be filed within one (1) year after such claim or cause of action arose, or it will be permanently barred.

16. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

17. Changes to These Terms

We may revise these Terms from time to time at our sole discretion. When we make material changes, we will update the effective date at the top of this page and may notify you by email or through the Service. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.

18. General Provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Mappetize regarding the Service and supersede any prior agreements. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
